Examination, review and analysis of the Greek and EU waste management policies and legislative framework
The main scope of Activity 1.2 is the examination, review and analysis of the Greek and EU legislative framework with respect to waste treatment and management. In the framework of this Activity, analysis of all relative European directives and policies as well as of the Greek legislative framework is foreseen in order to provide a clear context with respect to treatment and management of MSW including recyclables and biowaste.
In the framework of Activity 1.2, Deliverable 1-2 entitled: A technical report on the Greek and EU waste management policies, was prepared. This report contains information concerning existing European and Greek legislative framework with respect to solid waste management and treatment. Moreover, in the framework of this report, convergence of Greek and European legislation has taken place. Special focus is given to the Directive 2008/98/EC – Waste Framework Directive (WFD) and to the Law 4042/2012 (OG 24/Α/13.2.2012) by which WFD have been transposed into the Greek legislation.
For the conduction of this report 173 references have been examined including official legislative material (Directives, Regulations, Decisions, Laws, Joint Ministerial Decisions, Presidential Decrees, Circulars etc), reviews on legislation, internet sites etc. The relative legislation has been presented in three (3) basic categories. The categories, which are the same for both European and Greek legislation, are: (a) Framework Legislation on Solid Waste, (b) Legislation on Waste Management Operations and (c) Legislation on Packaging Waste and on Specific Waste Streams.
Based on the analysis presented in the report, the Greek National Legislative Framework on solid waste management is in line with the European Legislative Framework. More specifically, core European legislation under the three basic categories has been successfully incorporated into the national legislation.
The report has been completed on time and it was later updated in order to incorporate new Greek legislation which was published during 2012 with the most important to be Law 4042/2012 – Protection of the environment through criminal law – Transposition into national law of Directive 2008/99/ΕC – Framework for the production and the treatment of waste – Transposition into national law of Directive 2008/98/ΕC – Arrangement of issues related to the Ministry of Environment, Energy and Climate Change (OG 24/Α/13.2.2012). The following legislation has also been included in the updated version:

- Joint Ministerial Decision 15540/548/E103/2012 – Amend paragraph II of Article 18 of Presidential Decree 116/2004 (81/A) in compliance with the provisions of Directive 2004/37/EC amending Annex II to Directive 2000/35/EC of the European Parliament and Council on end-of-life (OG 945/Β/27.3.2012)
- Joint Ministerial Decision 1958/2012 – Classification of public and private projects and activities into categories and subcategories according to Article 1 paragraph 4 of Law 4014/21.9.11 (OG 21/Β/13.1.2012)
